1. Materialisation of the contract
By placing your order, you submit a binding offer to us to enter into a contract with you. We can accept this offer by sending you an order confirmation by e-mail or by delivering the ordered goods. You initially receive an e-mail confirming the receipt of your order which is sent to the e-mail address you have given us (confirmation of receipt of order). However, a purchase contract materialises only once we dispatch our order confirmation to you by e-mail or deliver the ordered goods.
There are two steps to the ordering process when you place an order through our online shop. As a first step, you select the goods you wish to receive. As a second step, you enter your customer data including the invoice address and, if applicable, a different delivery address and choose how you wish to pay. Payment is made according to the payment method you select (credit card, direct debit, PayPal, prepayment). Following this, you can order the goods by sending us your order after clicking on “Send order”.
2. Storage of the contract text
We store the contract text of your order. You can print this out after sending us your order by clicking on “Print” as a final step. We also send an e-mail confirming your order and an order confirmation with all the order data and our General Terms and Conditions to the e-mail address you have given us.
3. Reservation of ownership
The goods ordered remain our property until payment in full of all receivables.
4. Prices, dispatch costs, costs of return in the event of cancellation
All prices are final prices including the applicable rate of VAT. For goods with a value of up to EUR 50.00 (within Germany), dispatch costs are charged depending on the dimensions and weight of the goods. The dispatch costs amount to a flat rate of EUR 4.99 up to a weight of 31.50 kg. The dispatch costs for consignments sent outside Germany are calculated on the basis of the dimensions and actual weight.
You have the right to cancel this contract within thirty days without giving reasons. The cancellation period is thirty days from the date on which you or a third party named by you, who is not the carrier, took possession of the last goods. of your decision to cancel this contract by means of an unambiguous declaration (e.g. by means of a letter sent by post, fax or e-mail). To do so, you may use the cancellation form provided on the start page. However, use of this form is not mandatory.
To observe the cancellation period, it suffices if you send us the notification that you are exercising your right of cancellation before the end of the cancellation period.
Consequences of cancellation:
If you cancel this contract, we must reimburse to you all the payments that we have received from you, including the delivery costs (except for additional costs incurred because you requested a type of delivery other than the inexpensive standard delivery offered by us) without delay and no later than within fourteen days from the date on which we received your notification of the cancellation of this contract. We will use the same method of payment for this reimbursement that you used for the original transaction, unless expressly otherwise agreed with you; under no circumstances will you be charged any fees for the reimbursement. We may refuse reimbursement until we have received back the goods or until you have furnished proof that you returned the goods, whichever the earlier.
If you exercise an existing right of cancellation within Germany, we will pay the costs of returning the goods. Please see the start page for the returns link to return the goods. For returns from abroad, you must pay the customary costs of returning the goods. 5. Terms of delivery
The delivery times stated in the offer apply as delivery times and begin upon receipt of payment. In case of delivery based on payment by PayPal or credit card the delivery times begin upon acceptance of the contract by the company.
6. Terms of payment
Payment may be made either by prepayment by an advance bank transfer, by PayPal or by credit card (Visa, Master Card, American Express). We reserve the right to exclude individual payment methods. If prepayment is selected as a payment method, we will state the bank connection in the order confirmation. The invoice amount must be paid to our account within 10 days.
7. Warranty
The warranty is based on legal provisions. Insofar as used goods are the subject of the purchase contract and the customer is a consumer, the warranty period is one year for the purchase of used items.
8. Data protection
In the course of the initiation, conclusion, execution and reversal of a purchase contract, data are collected, stored and processed by us in accordance with legal provisions.
When visiting our internet site the IP address currently used by your PC, the date and time, type of browser, the operating system of your PC and the pages you have viewed are logged. However, conclusions cannot be drawn about personal data nor is this intended.
During the ordering process, your personal data are transferred encrypted using the SSL protocol (Secure Socket Layer) via the Internet. Credit card data are not stored, they are collected directly by our payment services provider and processed. We protect our website and other systems against the loss, destruction, access, modification or dissemination of your data by unauthorised persons using technical and organisational measures. Personal data that you provide to us, e.g. during an order or in an e-mail (e.g. your name and contact details) are processed only for correspondence with you and only for the purpose for which you provided the data to us. We only disclose your data to the forwarding agency entrusted with delivery insofar as this is necessary for the delivery of the goods. To process payments, we disclose your payment data to the bank instructed to make payment.
We assure you that we do not disclose your personal data to third parties for any other purpose, unless we are legally obliged to do so or you have given your express consent to such action in advance. Insofar as we use third-party services to execute and handle processing procedures, the provisions of the German Federal Data Protection Act are observed.
Duration of storage
Personal data notified to us via our website are stored only for as long necessary for the purposes for which the data were provided. If retention periods under commercial law and tax law must be observed, the duration of storage of certain data might last for up to 10 years.
Your rights
Should you no longer agree to the storage of your personal data or these no longer be correct, we will, upon request, arrange for the deletion, correction or blocking of your data in accordance with legal provisions. If requested, you will receive information free of charge on all personal data that we have stored on you.
